REAGAN JAMAIL TRAVEL

CLIENT CONTRACT, RELEASE OF LIABILITY AND TERMS & CONDITIONS

This Client/Participant Contract (the "Agreement") is legally binding. By checking the box on our inquiry form and/or sending the Planning Fee you (the "Client" or "Participant") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (this "Agreement"). This Agreement applies to all clients and participants (collectively, the "Participants") engaging with travel or trips curated by Reagan Jamail Travel ("we," "us," or "Reagan Jamail Travel"), including any Trip Planning Services provided. If you are agreeing on behalf of minor children (under age 18), you represent that you are their parent or legal guardian and bind them to this Agreement.

PRICING, PAYMENT AND BILLING

For the purposes of this Agreement, Reagan Jamail Travel's "Trip Planning Services" include but are not limited to meetings, telephone calls, research, document preparation and revision, correspondence, planning, suggestions, responses to Client's trip requests and changes, and all other work related to a Client's trip. The planning fee compensates Reagan Jamail Travel for its professional planning time, research, expertise, industry relationships, and the personal attention devoted to designing and coordinating Client's trip.

The planning fee starts at $400 and increases based on destination, length of travel, number of travelers, and the complexity of the booking. The planning fee is quoted to Client before work begins, is due before Reagan Jamail Travel begins work on a trip, and is non-refundable.

Trips requested on short notice require expedited research, coordination, and booking. For any trip requested 30 days or fewer before the departure date, Reagan Jamail Travel may charge an additional expedited planning fee. This fee increases the closer the request is made to departure, with trips requested 14 days or fewer before departure requiring the most compressed timeline. Any expedited planning fee will be quoted to Client before work begins and is due, along with the planning fee, before Reagan Jamail Travel begins work.

In addition to Trip Planning Services, Reagan Jamail Travel offers concierge services at a rate of $250 per hour. Any work requested by Client that falls outside the scope of the agreed Trip Planning Services may also be billed at $250 per hour, with prior notice to Client.

Because concierge services and certain third party costs are variable, Client understands and agrees that Reagan Jamail Travel cannot guarantee the total amount of concierge or trip related fees that may be incurred, and any estimates discussed are not binding on Reagan Jamail Travel.

Payment methods will be provided upon invoice. Credit card payments incur a 3.5% convenience fee. Payments will be processed within 14 days of the delivery of the invoice. Client authorizes Reagan Jamail Travel to store Client's designated credit card securely and to charge that card for Trip Planning Services, concierge services, and, as described in the Travel Supplier Costs section, for amounts due to Travel Providers for the arrangements Client has requested.

By agreeing to this Agreement, Client acknowledges and agrees that Reagan Jamail Travel's rates may increase over time, as advised by Reagan Jamail Travel to Client in advance, and Client agrees to pay the rates in effect when the applicable services are rendered.

Where concierge services or third party costs are incurred, an invoice for such fees and costs will be emailed to Client at the email address of record, generally on a monthly basis. Please review the invoice carefully and contact Reagan Jamail Travel if you have any questions about such invoice. Reagan Jamail Travel will process payment fourteen days following delivery of the invoice. If payment on an outstanding invoice is not received timely, Reagan Jamail Travel reserves the right to release your reservations and cancel your trip, but which action(s), for the avoidance of doubt, shall not release Client from any outstanding amounts owed to Reagan Jamail Travel. Client shall be responsible for all fees and charges related to such non-payment. Any misunderstandings or disputes by Client relating to any Reagan Jamail Travel invoice must be raised immediately with Reagan Jamail Travel. If Client does not raise any such misunderstanding, objections, or disputes to Reagan Jamail Travel within seven (7) days of receipt, Client will be deemed to have accepted the invoice as accurate. If client paid via credit card, Client's credit card on file will be charged within 14 days following the delivery of the invoice.

Reagan Jamail Travel at all times reserves the right to cease providing Trip Planning Services on any trip until any and all outstanding balances are brought to zero ($0) and failure or refusal to pay Reagan Jamail Travel invoices on a timely basis will constitute grounds for our immediate termination of this Agreement, but shall in no instance serve to release Client from his or her ongoing payment obligations to Reagan Jamail Travel. If Reagan Jamail Travel seeks payment on unpaid amounts owed by Client, Client hereby agrees to and shall indemnify Reagan Jamail Travel for all costs and expenses incurred by Reagan Jamail Travel with respect to same (including reasonable attorneys' fees and costs).

In certain cases, when paying by credit card, you may choose ability to dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Reagan Jamail Travel retains the right to dispute any chargeback that is improper and recover any costs, including attorney's fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback, in which case the cancellation charges as set out below would apply. The following chargeback scenarios are improper and we retain the right to investigate and rebut any such chargeback claims:

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.

  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.

  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier's product description.

  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of Reagan Jamail Travel or the Suppliers.

  • Chargebacks resulting because you do not agree with the cancellation policy.

SUPPLIER RULES AND RESTRICTIONS

Reagan Jamail Travel does not provide, own, or control any of the travel services and products that are provided as part of your trip, such as, but not limited to, flights, accommodations, rental cars, packages, or travel insurance (the "Travel Products"). The Travel Products are owned, controlled or made available by third parties (the "Travel Providers") either directly (e.g., airline) or as an agent. The Travel Providers are responsible for the Travel Products. The Travel Provider's terms and privacy policies apply to your booking so you must agree to and understand those terms. Furthermore, the terms of all actual Travel Providers (airline, hotel, tour operator, etc.) apply to your travel, so you must also agree to and understand those terms.

TRAVEL SUPPLIER COSTS

All costs charged by Travel Providers are the sole financial responsibility of Client. Client authorizes Reagan Jamail Travel to use Client's designated payment method, including a credit card that Client has authorized and that Reagan Jamail Travel stores securely, to pay Travel Providers directly for the travel arrangements Client has requested. In some cases, Reagan Jamail Travel will instead provide Client's payment authorization to the Travel Provider, or Client will pay the Travel Provider directly, as the Travel Provider requires.

In all cases, payment is applied directly to the Travel Provider. Reagan Jamail Travel does not hold, escrow, collect, or maintain Client funds in any account, and does not receive Client money for remittance to Travel Providers. Any charge made by Reagan Jamail Travel on Client's payment method is passed directly to the applicable Travel Provider for the specific arrangement authorized.

Travel Provider costs may be quoted in local currencies, and Reagan Jamail Travel will make reasonable efforts to secure favorable terms on Client's behalf. Rate quotes obtained from Travel Providers are typically time sensitive and often valid for a limited period, in many cases as little as two business days. If Client's payment is not completed within the applicable window, the quoted rate may lapse, and Client must request a new quote, which if obtained will be effective for the period then specified by the Travel Provider. Sales or other taxes and fees vary by location and trip specifics and will be disclosed to Client before a booking is confirmed.

Because all Travel Provider payments are applied directly to the Travel Provider, the travel contract for each booking is between Client and the Travel Provider. Reagan Jamail Travel bears no responsibility or liability for the financial failure, insolvency, nonperformance, or default of any Travel Provider.

POST-PURCHASE PRICE INCREASES

Client understands and agrees that Travel Providers and governing authorities may impose increased costs after a booking is confirmed, including but not limited to fare adjustments, fuel surcharges, resort or service fees, taxes, and charges arising from currency exchange fluctuations. Such increases may apply even after reservations are confirmed. Client is responsible for any such post-purchase increases imposed by a Travel Provider, and authorizes Reagan Jamail Travel to charge Client's designated payment method for these amounts, or Client will pay them directly to the Travel Provider, as applicable. Reagan Jamail Travel will notify Client of any known post-purchase increase before charging Client's payment method.

CHANGES TO YOUR TRIP

Clients may make changes to their trip, subject to availability of any such requested changes at the time such change request(s) are made, and all applicable amendment and cancellation charges incurred as a result of such change(s). Fees accrued for Reagan Jamail Travel Trip Planning Services prior to such change request(s) shall be deemed fully earned and new fees will be incurred based on the then-current Reagan Jamail Travel rates.

PARTICIPANTS WITH DISABILITIES

Participants with disabilities should notify Reagan Jamail Travel if ADA accessible accommodations are needed. Reagan Jamail Travel will make all reasonable efforts to accommodate this request but cannot be responsible if ADA accommodations are not available. Any accommodations provided will be at the sole expense of the guest requiring the accommodation.

CANCELLATIONS BY CLIENT

In the event the Client decides to cancel a trip after it has been booked, Reagan Jamail Travel will, if requested by Client, assist the Client with such cancellation subject to all applicable restrictions from the Travel Provider for the trip; provided, however, that Client shall be responsible for all applicable cancellation costs, charges or fees. Moreover, Reagan Jamail Travel may impose a cancellation fee of $500 or 10% of the booking total, upon review, to Client, it being understood and agreed to by Client that such cancellations may negatively affect Reagan Jamail Travel's relationship with third parties associated with the trip. In the event that Client initiates an improper credit card chargeback, Reagan Jamail Travel reserves its rights to commence legal action against Client and recover of its costs and fees in addition to the amount claimed in the chargeback.

CANCELLATION OR RESCHEDULING BY TRAVEL PROVIDER OR OTHER

In the highly unlikely event that one of our Travel Providers chooses to change the departure date, or cancels the trip, we will assist you in making alternate arrangements; however, you will be responsible for additional Travel Provider fees and charges that may apply. Reagan Jamail Travel will always advocate on your behalf in the event of a Travel Provider cancellation or rescheduling.

PASSPORT, VISAS, AND HEALTH REQUIREMENTS

It is Client/Participants sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination. In some countries entry may be subject to entry (reciprocity) fees and/or departure taxes/exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete.

Clients/Participants are urged to review advisories or warnings issued by the State Department and the Centers for Disease Control and Prevention about risks to travelers. Both the U.S. State Department and the Centers for Disease Control publish and update important country-specific information for travelers. Reagan Jamail Travel strongly recommends that Clients and all Participants review them. They can presently be found here. Reagan Jamail Travel bears no responsibility for such information and will not be responsible for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation/holiday related to improper documentation or government decisions about entry.

Clients and Participants are also encouraged to enroll in the U.S. Department of State's Smart Traveler Enrollment Program (STEP) at step.state.gov to receive safety, security, and emergency alerts from the nearest U.S. embassy or consulate while traveling.

Health Requirements: Recommended inoculations for travel may change and Client/Participant should consult a doctor for current recommendations before departure. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip.

TRAVEL WITH MINORS

Any minor child (under age 18) traveling as part of a trip is at all times in the care and legal responsibility of their accompanying parent or guardian. If a Participant is traveling with a minor child and is not the child's parent or legal guardian, that Participant must obtain and carry during travel a signed and notarized consent form from the child's parent or legal guardian authorizing the travel. If a Participant is traveling with their own minor child who does not share the Participant's surname, the Participant must obtain and carry during travel the child's birth certificate. Client/Participant assumes all responsibility for the potential risks, dangers, and costs associated with the travel of any minor child, and agrees that it is Client/Participant's sole responsibility to satisfy the entry and documentation requirements of each destination with respect to minor travelers.

REVIEW OF TRAVEL DOCUMENTS

Clients must completely review all travel, itinerary, and other documents related to a trip upon receipt of them, whether from Reagan Jamail Travel or a third party. Any errors, questions, or concerns should be communicated to Reagan Jamail Travel immediately. Client understands and agrees that names on all bookings must exactly match the traveler's valid passport and government issued identification. Client is responsible for reviewing every booking confirmation and travel document promptly upon receipt and for verifying all details, including traveler names, dates of birth, dates, times, destinations, accommodations, transportation, tours, and reservations. Client must notify Reagan Jamail Travel of any error, omission, or needed revision immediately, and in all cases within twenty four (24) hours of receipt. Client voluntarily assumes full responsibility for any costs, penalties, or losses resulting from a failure to report such errors or revisions within that time.

CONFIDENTIALITY AND OWNERSHIP OF PLANNING MATERIALS

All itineraries, proposals, research, recommendations, and other trip planning materials prepared by Reagan Jamail Travel are proprietary and confidential ("Confidential Information"). Client/Participant agrees to keep all such materials in strict confidence and to use them solely for the Client/Participant's own personal travel. Client/Participant may share an itinerary with an emergency contact prior to departure or as needed to obtain travel insurance.

Client/Participant agrees not to reproduce, resell, publish, distribute, or share any Confidential Information with any third party, and not to use any itinerary, research, supplier recommendation, or booking strategy prepared by Reagan Jamail Travel to arrange or book travel independently or through any other party. The relationships, sourcing, and planning methods reflected in these materials represent the professional work product of Reagan Jamail Travel and remain its property.

Reagan Jamail Travel will not disclose Client/Participant's personal or travel information, including traveler names, dates of birth, passport or identification details, itineraries, or contact information, to any third party except as necessary to arrange and book the requested travel with Travel Providers, or as required by law.

PRIVACY AND CLIENT DATA

To provide Trip Planning Services, Reagan Jamail Travel collects and stores personal information about Client and each Participant, which may include names, dates of birth, contact information, passport and other identification details, payment information, travel preferences, and loyalty or membership numbers.

Reagan Jamail Travel uses this information solely to research, arrange, book, and service Client's travel, and to communicate with Client about their trips. By engaging Reagan Jamail Travel, Client authorizes Reagan Jamail Travel to share this information with Travel Providers and other third parties, such as payment processors and host agency or consortium partners, as necessary to book and deliver the requested travel. Client warrants that any information provided on behalf of other Participants has been shared with that person's knowledge and permission.

Reagan Jamail Travel takes reasonable measures to safeguard Client information. However, Travel Providers and other third parties maintain their own privacy practices, which Reagan Jamail Travel does not control. Reagan Jamail Travel is not responsible for how any Travel Provider or third party collects, stores, uses, or protects Client information, or for any breach or misuse of information by such parties.

Reagan Jamail Travel retains Client information only as long as needed to provide services, meet legal and financial recordkeeping obligations, and support future travel planning. Client may request access to, correction of, or deletion of their personal information at any time by contacting Reagan Jamail Travel, subject to any records Reagan Jamail Travel is required to retain by law.

Reagan Jamail Travel does not sell Client personal information.

INSURANCE

Reagan Jamail Travel strongly recommends that Client/Participant obtain a comprehensive travel insurance policy covering Client and all Participants before, during, and after the trip. Certain countries require foreign visitors to hold valid medical insurance on entry. Reagan Jamail Travel cannot be held responsible for denied entry if a Client/Participant is unable to provide authorities with proof of insurance, or for denial of entry for any reason. Reagan Jamail Travel shall not be responsible for any costs incurred by Client or any Participant before, during, or after a trip as a consequence of inappropriate or insufficient travel insurance.

While Reagan Jamail Travel may offer coverage through certain carriers, we cannot compare all policies or providers available in the marketplace. The responsibility to research options and select a policy that fits your needs rests solely with you.

Client understands and agrees that they bear sole responsibility to read the terms of the travel insurance policy they select, including the extent of coverage and the procedures for filing a claim.

If you decline travel insurance, you acknowledge and accept liability for any cancellation penalties, damages, and expenses you incur, and you accept responsibility for arranging and paying for any medical care or treatment required during travel. You also acknowledge that you have waived this coverage, and your itinerary confirmation may note "declined" beside the insurance section. If you have not purchased travel insurance, you agree to review your confirmation for accuracy and to contact Reagan Jamail Travel immediately if you believe you hold insurance and the confirmation is incorrect. Failure to contact us will be treated as a waiver of travel insurance.

All claims or requests for reimbursement must be filed directly with your travel insurance provider under that policy's terms. Reagan Jamail Travel cannot advise on cancellations or the processing of claims, and will not communicate with your provider on your behalf. All questions regarding cancellations, penalties, and coverage should be directed to your provider. You acknowledge that Reagan Jamail Travel cannot be involved in any aspect of an insurance claim or request for service.

INDEMNIFICATION

Client/Participant agrees to and shall indemnify and hold harmless Reagan Jamail Travel and each of our officers, directors, employees and agents, from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, "damages") involved with or incurred by Reagan Jamail Travel (including, without limitation, reasonable attorneys' fees and the advancement of same) with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) Client/Participant's breach or violation, or threatened breach or violation, of this Agreement (including without limitation the Release) (ii) Client's failure to obtain any signed Release from a Participant and any damages claimed by such Participant or on such Participant's behalf against Reagan Jamail Travel with respect to the trip; and/or (iii) any Client/Participant's breach or violation, or threatened breach or violation, of the Release signed by such Client/Participant to the extent that such Participant is held not to be responsible for any damages incurred as a result of such breach or violation (real or threatened).

RELEASE FROM LIABILITY

Client/Participant hereby understands, acknowledges, and agrees that Reagan Jamail Travel, its owners, officers, members, employees, agents, representatives, affiliates and independent contractors (collectively "Reagan Jamail Travel") does not own or operate any entity which is to or does provide goods or services for any trip including without limitation, for example, partnership with, or ownership or control over hotels or other lodging facilities, airline, vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional or included excursions or equipment used thereon, food service or entertainment providers, etc. Client therefore releases and holds harmless Reagan Jamail Travel, its owners, officers, members, employees, agents, affiliates and independent contractors for any financial failure, insolvency and/or bankruptcy of any supplier, vendor and/or service provider (such as cruise line, airline, tour operator, accommodation provider, etc.), as well as negligent or willful act or failure to act of any such person or entity, or of any other third party, and Client/Participant agrees to and shall not make any claims against Reagan Jamail Travel for any such actions or omission by Reagan Jamail Travel or any such third parties.

Without limitation, Reagan Jamail Travel is not responsible for any injury, loss, or damage to any Client/Participant's person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, overbooking or downgrading of accommodations, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with or bites from animals, pests or insects, marine life or vegetation of any sort, dangers incident to recreational activities such as zip lining, snorkeling or scuba diving, paddle boarding, horseback riding, surfing, swimming, kayaking, sailing, canoeing, skiing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics or the threat thereof or for any other cause beyond the reasonable control of Reagan Jamail Travel. Reagan Jamail Travel reserves the right to change hotels, the itinerary, or other features of the Trip if Reagan Jamail Travel believes it will enhance the safety of the Trip for Client and the other Trip participants, but in each case, if feasible, with Client/Participant's prior consent.

In the event that the Client/Participant has arranged components of the trip without the assistance of Reagan Jamail Travel, Client/Participant is fully responsible for any losses, and associated costs, that arise as a result of the action or inaction of the component (for example, failure to arrive at a destination due to a delay or cancellation of a flight).

ASSUMPTION OF RISK; COVENANT NOT TO SUE

Client/Participant is aware that travel may involve hazardous activities, some in remote areas of the world. Inherent hazards and risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; Client/Participant's own negligence and/or the negligence of others, including tour guides, other guests, Reagan Jamail Travel employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical excursion for which Client/Participant is not prepared or other such accidents; the negligence or lack of adequate training of any agents or employees of Reagan Jamail Travel or their third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Client/Participant understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of any trip Client/Participant is willing to accept the risks and uncertainty involved as being an integral part of its adventure. Client/Participant hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Reagan Jamail Travel and agree to and shall hold harmless and fully release Reagan Jamail Travel from any and all claims associated with a trip, including any claims of third party negligence and Client/Participant hereby covenants not to sue Reagan Jamail Travel for any such claims or join any lawsuit or action that is suing Reagan Jamail Travel.

MAXIMUM DAMAGES

To the fullest extent permitted by law, the sole and exclusive remedy for any claim Client/Participant may bring against Reagan Jamail Travel arising out of or relating to this Agreement or the Trip Planning Services shall be limited to a refund of the Trip Planning Services fees Client paid directly to Reagan Jamail Travel. In no event shall Reagan Jamail Travel's total liability exceed the total Trip Planning Services fees paid by Client to Reagan Jamail Travel.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event shall Reagan Jamail Travel be liable to Client/Participant or to any third party for any consequential, indirect, incidental, special, exemplary, or punitive damages arising out of or relating to this Agreement or the Trip Planning Services, regardless of whether such damages were foreseeable, whether Client/Participant was advised of the possibility of such damages, and regardless of the legal theory on which the claim is based.

FORCE MAJEURE

Reagan Jamail Travel shall not be liable or responsible for any failure or delay in performing its obligations under this Agreement, and shall not be deemed to have breached this Agreement, where such failure or delay results from events beyond Reagan Jamail Travel's reasonable control that were unforeseeable at the time Client engaged Reagan Jamail Travel. Such events include but are not limited to acts of God; natural disasters such as fires, earthquakes, hurricanes, floods, storms, or infestations; epidemics or pandemics; war, invasion, hostilities, terrorist threats or acts, riot, or other civil unrest; government orders, laws, actions, embargoes, or advisories; national or regional emergencies; strikes or other labor disturbances; and shortages or disruptions of transportation, power, or other essential services. Any Trip Planning Services fees and other amounts paid by Client prior to a force majeure event are nonrefundable to the extent those fees have been earned or those amounts have been paid to or committed with Travel Providers.

COMMUNICATION

Reagan Jamail Travel's office hours are Monday through Friday, 9:00 AM to 5:00 PM Central Time, excluding holidays. Communication is conducted by email at reagan.jamail@smartflyer.com and rjtraveladmin@smartflyer.com. Reagan Jamail Travel will respond to Client emails during office hours, generally within two (2) business days of receipt. In the event a response from Client is needed and communication has stalled, Reagan Jamail Travel will notify Client that a response is required within twenty four (24) hours. If Client does not respond within that period, Client understands and agrees that Reagan Jamail Travel shall not be liable for any resulting delays, missed opportunities, or changes in pricing, availability, or travel arrangements, and Reagan Jamail Travel reserves the right to suspend or terminate Trip Planning Services.

All Trip Planning Services are conducted through email and scheduled calls arranged in advance. Reagan Jamail Travel does not provide Trip Planning Services, take booking instructions, or accept trip requests or changes through social media, direct messages, text or SMS message, or unscheduled telephone calls. Requests or instructions sent through these channels may not be received, reviewed, or actioned, and Client understands and agrees that Reagan Jamail Travel is not responsible for any delay, error, missed booking, or other consequence resulting from communications sent outside of the methods described in this section. To ensure a request is properly received and documented, Client must send it by email to one of the addresses above.

GOVERNING LAW; SUBMISSION TO JURISDICTION

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Texas, USA, exclusive of conflict or choice of law rules. Client/Participant agrees that unless otherwise mutually agreed by the parties in writing or as otherwise, any Claims shall be brought in a court located in Travis County, the State of Texas, USA. Unless otherwise prohibited by applicable law, any Claim must be brought within two (2) years from the date on which such Claim arose or accrued.

CHANGES TO THESE TERMS

Reagan Jamail Travel reserves the right, in its sole discretion, to revise or update these Terms and Conditions at any time. The version of these Terms and Conditions that applies to a trip is the version in effect on the date Client accepts this Agreement or pays the Planning Fee, whichever occurs first. Any updates made after Client's acceptance apply only to future trips or future agreements, unless Client is provided notice of and agrees to the updated Terms.

ENTIRE AGREEMENT; SEVERABILITY

This agreement, including any other attachments and exhibits referenced herein, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Reagan Jamail Travel. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

KNOWING AND VOLUNTARY EXECUTION

Client/Participant has carefully read this Agreement, and fully understands its contents. Client/Participant are aware that this is a release of liability and a contract between them and Reagan Jamail Travel and/or its affiliated organizations and Client/Participant knowingly agrees to it of their own free will, without duress.
